BACKGROUND In 1984, the City Council amended the San José Municipal Code to prohibit all fireworks, including “safe and sane” varieties, except for controlled public fireworks displays conducted by licensed pyrotechnicians and authorized through permits issued by the Fire Department. In August 2014, in response to a rise in noise and safety complaints from residents, the City Council directed the City Manager to revise the City’s fireworks enforcement approach. Both the Fire Department and the Police Department were tasked with identifying enforcement mechanisms to deter and ultimately reduce the illegal sale, use, possession, and storage of fireworks.
